These Terms of Use (“Terms”) govern your access to and use of the Tarablic website, including all related pages, content, features, products, and services made available through our online store (collectively, the “Site”).
This Site is operated by Tarablic (“Tarablic,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Eligibility
By using this Site, you represent that you are the age of majority in your province, state, or country of residence, or that you are using the Site under the supervision of a parent or legal guardian where permitted by law.
2. Use of the Site
You may use this Site only for lawful purposes and in accordance with these Terms.
You agree not to:
- use the Site in any way that violates applicable law or regulation
- interfere with or disrupt the security, operation, or performance of the Site
- attempt to gain unauthorized access to any part of the Site, its servers, or related systems
- use any robot, scraper, spider, or similar automated means to access, monitor, copy, or extract content from the Site without our prior written consent
- introduce malicious code, viruses, or other harmful material
- impersonate another person or misrepresent your identity or affiliation
- use the Site in a way that could damage Tarablic’s reputation or interfere with another user’s use of the Site
We reserve the right to suspend or restrict access to the Site if we believe a user has violated these Terms or applicable law.
3. Product Information and Availability
We aim to present our instruments, accessories, and related content as accurately as possible. However, product descriptions, images, finishes, woods, colors, dimensions, and other details may vary slightly from what appears on screen, including due to photography, display settings, or the handcrafted nature of certain products.
All products are subject to availability. We reserve the right to limit quantities, discontinue products, or change product details, pricing, or availability at any time without notice.
Nothing on this Site constitutes a binding offer to sell until your order has been accepted by us.
4. Orders and Acceptance
When you place an order through the Site, you are making an offer to purchase the selected product(s). After you place an order, you may receive an email acknowledging receipt of your order. That acknowledgment does not mean the order has been accepted.
Your order is accepted only when we confirm shipment or otherwise confirm acceptance of the order.
We reserve the right to refuse, cancel, or limit any order, including where:
- a product is unavailable
- pricing or product information contains an error
- we suspect fraud, unauthorized activity, or misuse
- we are unable to process payment
- the order appears to violate these Terms
If we cancel an order after payment has been processed, we will issue a refund for the amount charged, subject to applicable law.
5. Pricing and Payment
Unless otherwise stated, all prices displayed on the Site are in Canadian dollars (CAD).
Prices do not necessarily include taxes, shipping charges, customs duties, import fees, or other government charges unless expressly stated at checkout. These amounts, where applicable, will be shown during checkout or remain the responsibility of the customer depending on the destination.
By submitting payment information, you represent and warrant that:
- you are authorized to use the payment method provided
- the billing information you submit is accurate and complete
We reserve the right to correct pricing errors, even after an order is submitted. If a pricing correction affects your order, we may contact you for instructions or cancel the order and issue a refund.
6. Shipping and Delivery
Shipping times provided on the Site are estimates only and are not guaranteed unless explicitly stated otherwise.
We may use third-party shipping providers and may ship orders in separate packages where appropriate.
Risk of loss and title for physical goods generally pass to you upon delivery to the shipping carrier or upon delivery to the destination, subject to applicable consumer protection law. If your order arrives damaged, incomplete, or appears lost in transit, please contact us promptly at info@tarablic.ca.
Additional shipping policies, delivery terms, or customs information may be posted separately on the Site and will form part of these Terms where applicable.
7. Returns, Exchanges, and Refunds
Returns, exchanges, and refunds are governed by our separate Return Policy or Refund Policy, where posted.
Nothing in these Terms limits any non-waivable rights you may have under applicable consumer protection laws.
Because Tarablic offers premium handcrafted instruments, certain items may be subject to special return conditions. Please review the applicable return policy before making a purchase.
8. Accounts
You may have the option to create an account on the Site.
If you do, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information and to update it as needed.
We reserve the right to suspend or terminate accounts that contain inaccurate information, are used in violation of these Terms, or are suspected of unauthorized or fraudulent activity.
9. Reviews, Submissions, and User Content
If you submit reviews, comments, messages, photos, testimonials, or other content to us or through the Site (“User Content”), you represent that:
- you own or control the rights necessary to submit that content
- your User Content is accurate and not misleading
- your User Content does not violate any law or any third party’s rights
- your User Content is not defamatory, abusive, obscene, threatening, discriminatory, or otherwise unlawful
By submitting User Content, you grant Tarablic a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, adapt, publish, display, and distribute that content in connection with our business, marketing, products, and services, subject to applicable law.
We are not obligated to publish or maintain any User Content and may remove it at our discretion.
10. Intellectual Property
All content on the Site, including text, logos, graphics, product names, images, audio, video, design elements, and site layout, is owned by Tarablic or its licensors and is protected by applicable intellectual property laws.
You may view and use the Site for personal, lawful, non-commercial purposes only. You may not reproduce, republish, distribute, modify, create derivative works from, publicly display, or exploit any part of the Site without our prior written permission.
Nothing in these Terms grants you any ownership rights in the Site or its content.
11. Third-Party Services and Links
The Site may include links to third-party websites, platforms, apps, or services. We provide these links for convenience only.
We do not control and are not responsible for third-party sites, their content, accuracy, availability, or privacy and security practices. Your use of third-party services is at your own risk and may be governed by separate terms and policies.
12. Privacy
Your use of the Site is also subject to our Privacy Policy, which explains how we collect, use, and disclose personal information.
By using the Site, you acknowledge that you have reviewed our Privacy Policy.
13. Disclaimer
The Site and all content, products, and services made available through it are provided on an “as is” and “as available” basis, except as otherwise expressly stated in writing or required by law.
To the fullest extent permitted by law, Tarablic disclaims all warranties, representations, and conditions of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.
We do not guarantee that the Site will be uninterrupted, secure, error-free, or free of viruses or other harmful components.
14. Limitation of Liability
To the fullest extent permitted by law, Tarablic and its directors, officers, employees, affiliates, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of revenue, loss of business, loss of opportunity, or loss of data, arising from or related to your use of, or inability to use, the Site.
To the fullest extent permitted by law, if Tarablic is found liable to you for any claim arising out of or relating to the Site, our total liability will not exceed the greater of:
- the amount you paid to Tarablic for the relevant product or service giving rise to the claim, or
- CAD $100
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including certain rights under consumer protection legislation.
15. Indemnity
To the fullest extent permitted by law, you agree to indemnify and hold harmless Tarablic and its affiliates, officers, directors, employees, contractors, and service providers from and against claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of:
- your misuse of the Site
- your violation of these Terms
- your violation of applicable law
- your infringement of any third-party rights
16. Termination
We may suspend, limit, or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms, applicable law, or the security or integrity of the Site.
Any provisions that by their nature should survive termination will survive, including provisions relating to intellectual property, disclaimers, limitations of liability, indemnity, governing law, and dispute resolution.
17. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Site will be brought before the courts of Ontario, unless applicable law requires otherwise.
18. Changes to These Terms
We may update these Terms from time to time to reflect changes to our Site, business practices, or legal requirements.
When we do, we will post the revised version on this page and update the “Last updated” date above. Your continued use of the Site after any update means you accept the revised Terms, to the extent permitted by law.
